司法委員職位申請

香港中文大學學生會(‘學生會’)司法委員推薦小組(‘推薦小組’)現邀請任何擬出任司法委員的基本會員提交申請,參與遴選程序。

司法委員的權責
司法委員是學生會司法機構的成員,任期為獲委任起後兩年。司法委員負責必須秉持維護法治和司法獨立原則,獨立行使司法職權,捍衛《學生會會章》和保障基本會員權利。

司法委員的資格
有關司法委員的資格的條文,請參考《司法委員會條例》第15條。

司法委員應具備的能力
任何獲推薦出任司法委員的人選均應具備以下條件:

  1. 領導才能:具有領導司法機構的責任感和使命感,確保司法事務有效率 (efficient) 及有效(effective) 進行,在司法機構使用者面前擔當公眾代表。
  2. 作出判斷的能力:能展現公正性,以獨立思考作清晰、公允和法律上穩妥的決定。
  3. 擁有知識和建立知識的能力:對《學生會會章》、章則、現實法律及它們的實際運作有充分認識,能展現專業學習和發展的能力、意願和決心,以及鼓勵其他人仿效。
  4. 理解和疏理資料的能力:能迅速理解資料並指出主要問題,能建立對案件的清楚認知和藉著查找資料澄清含糊的地方。
  5. 與其他人合作和溝通的能力:(其他人指同事、各方代表及當事人、證人及其他司法機構使用者)妥當地主持學生會司法程序,重視多元和明白溝通的重要性。展現良好的溝通技巧及同理心。在適當時向司法機構使用者表達善意。
  6. 有效率地管理工作的能力:有效地工作和計劃,在有限資源下確保司法制度能發揮最佳作用。

司法委員的委任程序

  1. 2017519日(星期五)下午530分前,提交附件的表格至范克廉樓地庫香港中文大學學生會會室。逾期申請恕不受理。如填寫資料有錯漏,請電郵至[email protected]作出更改。
  2. 推薦小組收到申請人的申請後,將會向你發出確認函確認已接獲申請。
  3. 推薦小組將於稍後時間,安排申請人完成一項筆試和面試;有關詳情將稍後向申請人公佈。
  4. 推薦小組會以能力為基準(即上述司法委員應具備的條件),獨立評核每一位申請人。於推薦小組的每一位委員為申請人評分後,推薦小組將再次討論申請人的能力。
  5. 有關討論完結後,推薦小組將就是否推薦該申請人進行表決。申請人如得到推薦小組全體委員三分之二或以上贊成,即獲推薦小組提請代表會確認委任。
  6. 代表會收到小組的推薦名單後,將考慮確認所有推薦小組提請委任的獲推薦人選;在獲得代表會出席會議的代表三分之二或多數贊成後,代表會將提請會長簽署委任名單上的獲推薦人選為司法委員。
  7. 最後,學生會會長將簽署該推薦名單,委任名單上的所有人選為司法委員。

推薦小組歡迎學生會基本會員申請出任司法委員,以司法委員身份服務全體會員。如對司法委員的委任程序有任何查詢,可隨時電郵[email protected]查詢。

Dear Union Members,

RE:       Selection Process for Members of the Judicial Committee, The Student Union of the Chinese University of Hong Kong (theUnion’) – Invitation for Applications

The Judicial Appointment Commission (the ‘Commission’) now invites applications from Union Members who intend to become the Members of the Judicial Committee (‘MJCs’).

Role of MJCs

MJCs are member of the Union Judiciary. They serve for a term of 2 years from the day of appointment. MJCs must maintain and uphold the rule of law and the principle of judicial independence, by exercising their judicial functions independently, defending the Union Constitution and safeguarding the rights of Union Members.

Qualifications of MJCs

Please refer to section 15 of the Judicial Committee Ordinance for the statutory requirements of the qualifications of MJCs.

Competencies required of MJCs

In making the recommendations, the Commission must be satisfied that the candidates possess the following competencies:

  1. Leadership: Has a sense of responsibility and mission to lead the Judiciary; Ensures judicial business is conducted effectively and efficiently; Acts as the judicial figurehead to court users.
  2. Exercising judgment: Demonstrates integrity and applies independence of mind to make incisive, fair and legally sound decisions.
  3. Possessing and building knowledge: Possesses a detailed knowledge of the Union Constitution, the Union laws, the laws of real-life jurisdictions and practice and demonstrates an ability and willingness to learn and develop professionally.
  4. Assimilating and clarifying information: Quickly assimilates information to identify essential issues, develops a clear understanding and clarifies uncertainty through eliciting and exploring information.
  5. Working and communicating with others: Conducts proceedings appropriately, values diversity and shows empathy and sensitivity in building relationships.
  6. Managing work efficiently: Works effectively and plans to make the best use of resources available.

Appointment of MJCs

  1. Application form (see the enclosure) must reach the Union Office (LG Benjamin Franklin Centre) at or before 5.30pm of 19th May 2017 (Friday). No late application will be entertained. If any error is discovered in the application form after it is tendered, please email [email protected] to make changes.
  2. The Commission will acknowledge the receipt of the application form by sending a Letter of Confirmation to the candidates.
  3. The Candidates will participate in a written exam and will be interviewed by the Commission, details of which will be released at a later stage.
  4. The Commission will assess independently and separately each of the candidates on merits (i.e. with reference to the competencies required of MJCs). After every member of the Commission has made his/her assessment, the Commission will deliberate and vote on whether a recommendation should be made.
  5. If a candidate secures the support of two-third of all members of the Commission, he/she will be included in the list of recommendations to be sent to the Council for its endorsement.
  6. If the Council endorses the list of recommendations by two-third majority of the Councillors present, the President of the Union will be asked to appoint MJCs as on the list.
  7. The President of the Union signs the letters of appointment to appoint MJCs as on the list.
